Can balconies project into a required setback?

Answered and approved · Planning · kept in 1 place

A balcony is not identified as a permitted encroachment into a required setback under the Planning (Residential Zones) Technical Specifications 2026 (NI2026-303). Section 14.5 – Encroachments provides a specific list of elements that may encroach into minimum setbacks, and balconies are not included in that list. Therefore, a balcony cannot rely on the 14.5 encroachment allowance and must be considered when determining compliance with the applicable setback.

A balcony cannot use the setback encroachments allowed under 14.5 because balconies are not included in the list of permitted encroachments.

Section 14.5 allows certain elements into setbacks, including eaves or roof overhangs up to 600 mm, fascias, gutters, downpipes, light fittings, sun blinds, qualifying landings, steps and ramps, as well as certain items within side and rear setbacks only, including unroofed pergolas.

A balcony is not listed.
