Can I build over or near an easement?

Kept in 2 places · they do not agree

Dual Occupancy Q&A this one governs

If a pipe runs underneath the proposed dwelling, first determine what the pipe is and who owns it.

  • Sewer: Icon Water controls ACT water/sewer network assets. Alteration or relocation may be possible with Icon Water approval, although not all assets can be altered and approved works are generally at the applicant's expense.
  • Municipal stormwater: A new dwelling/building is not permitted within a stormwater easement. City Services does, however, have an approval process covering infrastructure relocation or removal.
  • Private drainage: This may potentially be redesigned or relocated as part of the development's plumbing/drainage design.

Importantly, moving the pipe does not automatically remove its easement. An existing easement may need to be legally changed or extinguished separately.

Dual Occupancy Q&A

It depends on the easement. An easement can restrict where a dual occupancy, driveway or other structures can be located, so it should be identified and considered when designing the development.

For a dual-occupancy DA, the requirements depend on the purpose of the easement and the entity responsible for it. You may need to maintain required clearances, obtain advice or approval from the relevant entity, or redesign the development so it does not interfere with the easement. ACT Planning specifically identifies utilities and easements as matters that should be considered when preparing a DA.

Can both dwellings share a driveway?

Kept in 2 places · they do not agree

Dual Occupancy Q&A this one governs

Yes. Both dwellings in a dual occupancy can share a driveway, provided the driveway, parking and vehicle-access arrangement meets the applicable planning requirements.

The Missing Middle Housing Design Guide specifically recognises dual occupancy as multi-occupancy housing and refers to common landscaping where there is a shared driveway.

Under the Residential Zones Technical Specifications, the driveway and parking arrangement must also address requirements including:

  • Required car parking: the required number of parking spaces must be provided for the dwellings.
  • Parking location: parking must comply with the rules about where spaces can be located on the block.
  • Tandem parking: spaces can be in tandem only where they belong to the same dwelling. This is important—a shared driveway does not mean one dwelling's required parking space can be trapped behind the other dwelling's parking space.
  • Property boundaries: parking spaces must not encroach across property boundaries.
  • Safe driveway design: Specification 27.4 requires verge crossings and internal driveways to be designed for safe use by pedestrians, cyclists and vehicles, including consideration of vehicle-speed reduction measures.
  • Garage/carport presentation: where garages or carports face a street, their openings are also subject to applicable streetscape controls.

The overall arrangement must therefore provide compliant vehicle access, parking and safe movement, even though the physical driveway itself may be shared.

Dual Occupancy Q&A

Yes. Both a secondary residence (granny flat) and a dual occupancy can generally share the same driveway in the ACT. You do not necessarily need to provide a separate driveway for each dwelling, as long as the shared driveway provides suitable access and the required parking is provided.

Can you explain allowances?

Kept in 2 places · they do not agree

The older business set this one governs

Allowances are budgets set for certain items in your home so you can choose the exact finishes and fittings that suit your preferences. For example, we might allow $50/m² for tiles-if your home has 60m² of tiling, that gives you a $3,000 budget.

If you select tiles that cost less, you save money; if you choose something more expensive, the difference is added to your contract.

This gives you flexibility to prioritise where you want to spend or save-for instance, using savings on tiles to upgrade to a higher-end benchtop. In the HIA contract, these are referred to as 'Prime Cost Items', but we simply call them allowances to keep things clear. All allowances are clearly outlined in your project proposal so you have full visibility and control over your selections and budget.

In any building project, many individual items makeup the end project. It is our objective to enable our customers to have control over as many of those items as practically possible.

Do I need approval for a new driveway or verge crossing?

Kept in 2 places · they do not agree

Dual Occupancy Q&A this one governs

Yes. A new driveway or verge crossing requires driveway approval from ACT City Services. For a dual occupancy, the proposed driveway may also form part of the Development Application and must comply with the applicable planning requirements.

A Building Approval alone does not approve the driveway—ACT City Services specifically states that stamped BA drawings from a certifier do not mean the driveway is approved.

Dual Occupancy Q&A

Yes. If your dual occupancy requires a new driveway or a change to an existing driveway or verge crossing, separate driveway approval may be required.

ACT Government requires driveway approval to:

  • construct a new driveway; or
  • change the location, dimensions, layout or material of an existing driveway.

A second driveway and kerb crossing may also be permitted to service an additional approved dwelling, subject to the applicable safety, access and design requirements.

Importantly, having stamped Building Approval drawings does not automatically mean the driveway is approved.

Does the shape of my block affect what I can build?

Kept in 2 places · they do not agree

Dual Occupancy Q&A this one governs

There is no general rule saying that a block must be rectangular. However, its shape can influence where and how much you can build.

For example, on a triangular or irregular block, the side boundaries may converge toward the rear. Once the required setbacks are applied, the resulting buildable area may become narrower, which can affect the size, position and layout of the proposed dwelling.

Similarly, a narrow block may make it more difficult to accommodate a driveway, parking, planting and private open space while still meeting the required building setbacks.

The important point is that block shape itself is not necessarily a restriction; it is how that shape interacts with the applicable planning controls that determines the development potential.

Dual Occupancy Q&A

Two blocks with the same land area can have very different development potential because of their shape.

A wide, regularly shaped block may provide more flexibility for positioning dwellings, parking and outdoor areas. A narrow, triangular, irregular or battle-axe block may have less usable space once the required setbacks, driveway and other site requirements are taken into account.

This does not mean an irregular block cannot be developed. It may simply require a more carefully designed layout to make good use of the available space.

How do Progress Payments work?

Kept in 2 places · they do not agree

The older business set this one governs

In the project proposal present to our customer, we provide an infographic that explains the milestone events and the percentage payments that are linked to those stages in the project.

When we complete those stages and milestones, we will invoice you. Most of the percentage payments are between 10-15%, and we believe that these smaller incremental payments protect the consumer.

If we would like to start building quickly, what is our best option?

Kept in 2 places · they do not agree

The older business set this one governs

If you would like to build quickly, we suggest being as prepared as possible for the initial design meeting. This is due to the design phase being the only aspect in the overall process that we have some control over regarding the length of time required. Therefore, the best option is firstly to figure out exactly what you require in the design (in terms of bedrooms, living space, etc.).

Once you have figured out your needs and wish list, it is a good idea to go through our designs on the website to decide if you would like a modification or custom design. You should also consider where in your backyard you would like to site the building and why.

Finally, you should think about materials for the external cladding of the building, as this will be helpful for us to know in the initial design meeting.

What happens if we want to make changes after approving the design?

Kept in 2 places · they do not agree

The older business set this one governs

We are more than happy to accommodate your needs and changes to deliver your preferred design. If the changes are reasonable, we won't apply any additional fees.

If you require substantial changes, an entirely different design, and/or we haven't commenced planning approvals or Inclusions plans, then we will reach an agreement on the costs associated to achieve your desired changes. This is based on an hourly rate of $120 inc GST,

Common planning approval questions

We want you to have the perfect design, however ongoing revisions after we commence the inclusions and planning approvals stages result in time delays and financial costs. Window, door, cupboard and kitchen layout changes can be easily managed in the inclusions process without time delays or design costs. When changes to the structural footprint of the design are required, this can have significant impacts on the planning rules and the costs to construct. It may seem straightforward to move a wall 500mm to the west, add 1 meter to the design, and change the position of the laundry. However, these changes need to be redrawn and may trigger changes to engineering plans and implications regarding planning approvals. We would prefer that your design is perfect, but please note that there will be associated costs and time delays if we need to make changes as outlined above. Any structural changes, e.g. moving walls, adding a meter to the design, relocating laundry, etc., will take 2-4 weeks in design and estimating. This is the only way to recalibrate and adjust our fixed price guarantee and ensure we will meet planning regulations and codes. The associated fees to engage our planning team equate to approximately $120per hour inclusive of GST. If you decide that you want to initiate design changes that require structural changes, we will provide a simple estimate of total hours. Then enter into a project variation to the original agreement.
